The Telephone Consumer Protection Act (“TCPA”) restricts calls to cell phones, telemarketing calls, as well as the use of automated telephone dialing equipment, the use of artificial or prerecorded voice messages, SMS text messages, and fax machines. The statute prohibits businesses from making a “call” to a consumer's cell phone without his or her “prior express consent.” If you have received such calls, without your consent, you may have had your rights violated under the TCPA.
